Mandatory Mediation in Commercial Disputes

In commercial disputes, mediation is a statutory prerequisite before litigation in certain categories of claims. Scope and preparation depend on the specific facts of each case.

Commercial relations can lead to claims concerning receivables, damages or contract enforcement. Determining the applicable procedural path requires analyzing the nature of the claim and desired legal outcome, rather than relying solely on the merchant status of the parties.

Article 5/A of the Turkish Commercial Code establishes mediation as a procedural prerequisite in specified commercial lawsuits. Because the scope of eligible claims evolves, the currently applicable statutory text must be checked prior to filing. The prerequisite does not force parties to settle; voluntary participation and equal treatment remain fundamental principles.

Preparation should involve a structured review of contracts, invoices, payment records and formal notices along an accurate chronological timeline. Settlement documents must be carefully scrutinized regarding scope and enforceability under applicable laws. (Source: TCC Art. 5/A, Law No. 6325).
